This privacy notice applies solely to information collected by this website. These terms and conditions apply to DSWD Wiserv Registered User / DSWD Wiserv moderators/focal (defined below).

1.Confidential Information means any information that is proprietary or confidential which is expressly identified as such by the Party making the disclosure.

1.1 Parties means the DSWD Wireless Service Wiserv and the Registered User / DSWD Wiserv moderators/focal. 1.2 Password means the password in respect of a unique Username created by (as the case may be) you which would allow you to gain access to the Registered User / DSWD Wiserv moderators/focal Services of the DSWD Wiserv. 1.3 Registered User / DSWD Wiserv moderators/focal means you who have duly completed the free Registered User / DSWD Wiserv moderators/focal registration process and who have successfully created a Username and Password. 1.4 Registered User / DSWD Wiserv moderators/focal Services means the User’s services defined in Clause 2.1 which are accessible by a Registered User / DSWD Wiserv moderators/focal from the Website: https://wiserv.dswd.gov.ph . 1.5 Username means a unique username created by (as the case may be) you, which, when the relevant Password is entered will grant such you access to the relevant Registered User / DSWD Wiserv moderators/focal Services. 1.6 Website means https://wiserv.dswd.gov.ph or such variations to the name of the aforesaid domain name. 1.7 The authority to access the User’s Services commences upon the relevant Username and Password being successfully created by the User and ends if these terms and conditions are terminated under Clause 7.

2. REGISTRATION

2.1. In order to access Registered User / DSWD Wiserv moderators/focal Services (DSWD Wiserv) from the Website and/or access certain sections on the (‘Registered User / DSWD Wiserv moderators/focal Services’), you will need to register as a Registered User / DSWD Wiserv moderators/focal of the DSWD Wiserv. 2.2. In account registration, the user must register and use his/her complete name and must follow the prescribed username naming convention -Firstname Initial, Middle name Initial and complete Last Name. eg. gntolentino 2.3. The authority to access the Registered User / DSWD Wiserv moderators/focal’s Services commences upon the relevant Username and Password being successfully activated by Helpdesk Administrator and ends if terminated pursuant to Clause 7. 2.4. You are solely responsible for the security of your Username and Password and must not disclose your Username and/or Password to anyone. You must inform the ICTMS immediately if your Username and/or Password have been compromised. In such a case, the Wiserv Admin will reset your Username and/or Password for you. In this regard, please report via ICT Helpdesk https://ictsupport.dswd.gov.ph

3.Registered User / DSWD Wiserv moderators/focal OBLIGATIONS

3.1. Subject to Clause, you shall not: 3.1.1 make available your Username and Password and/or any part of the Registered User / DSWD Wiserv moderators/focal Services available to anyone. Where such disclosure of Username and/or Password occurs, you shall inform the ICTMS immediately so that the Wiserv Admin can take appropriate security measures. In addition, if you wish to unregister yourself as a Registered User / DSWD Wiserv moderators/focal, you agree to inform the ICTMS of the same so that the DSWD Wiserv Admin can update the system, please report via ICT Helpdesk https://ictsupport.dswd.gov.ph; 3.1.2 use the relevant Registered User / DSWD Wiserv moderators/focal Services and/or information extracted or downloaded for any illegal, fraudulent, immoral or any non-official purposes. 3.2. You agree to notify the ICTMS immediately of any errors or inaccuracies in respect of any information and/or data extracted from any module of the Wiserv which forms part of the Registered User / DSWD Wiserv moderators/focal Services. In this regard, you shall report via ICT Helpdesk via https://ictsupport.dswd.gov.ph 3.3. The Office/Bureaus/Service/Units/Field Office requesting for a keyword must submit the following: 3.3.1 Business Process / Workflow to which the DSWD Wiserv shall be applied to ensure the proper management and treatment of the received SMS and with compliance to RA 11032 Ease of Doing Business Act; 3.3.2 Secondary Keyword -keyword identifier unique per service/ program; 3.3.3 Confirmation Text -autoreplies received by the clients as they text using the Secondary keyword;; 3.3.4 Message Footer- instruction or notification found on the bottom most of the Confirmation message; 3.3.5 Description - information related to the the service and secondary keyword; 3.3.6 Message format/ requirement - parameters requirement of the requesting OBSU. 3.4. The DSWD Wiserv moderators/focal must only use the outgoing SMS for DSWD related purposes and official transactions. 3.5. The DSWD Wiserv moderators/focal is responsible for the appropriate utilization keyword and access level requested. 3.6. The OBSU/Program DSWD Wiserv moderators/focal must correct the category of the misrouted SMS from their respective folder to the applicable folder through “Category” update. 3.7. The DSWD Wiserv moderators/focal must update the status of the received SMS through the following Message status: 3.7.1 Done (Done)- Status for the Resolved/ acted upon messages 3.7.2 Assessing(A)- Message status for evaluations to determine if request is within the scope of the services offered by the moderating OBSU / Program. 3.7.3 Verifying (V)- Message status for evaluation to determine if requests have met the parameters set by the moderating OBSU. If the message content has a complete information needed for the facilitation of the request. 3.7.4 Read ( R )- Message status for messages that have yet to be determined. 3.7.5 Bypassed(B )- Message status for messages that are not related to DSWD programs and services. 3.8 The DSWD Wiserv moderators/focal / shall request the activation of account via https://ictsupport.dswd.gov.ph 3.9 Professionalism must be practiced in each and every replies and SMS broadcast. Degrading and indecent replies to clients/DSWD Employees and SMS broadcast are strictly prohibited. 3.10 The DSWD Wiserv moderators/focal must agree on the DSWD Wiserv Terms and Condition prior activation of Wiserv account.

4.THE DSWD WISERV OBLIGATIONS

4.1 The ICTMS warrants that, to the best of its knowledge, the Registered User / DSWD Wiserv moderators/focal Services will not infringe any patents, designs or copyright of any third party. In the event you are aware and/or have reasonable suspicion that the Registered User / DSWD Wiserv moderators/focal Services may infringe the intellectual property of any third parties, you agree: 4.1.1 to notify the ICTMS as soon as it is practicable of any such claim being made; 4.1.2 that the ICTMS shall be entitled at its expense to conduct any litigation that may ensue and negotiations for settlement of such claim; and 4.1.3 that you shall give the ICTMS all information and assistance reasonably necessary (at the ICTMS expense) to defend or settle such claim and you shall not compromise or settle such claim. 4.2 The ICTMS reserves the right to update and/or make changes to the Registered User / DSWD Wiserv moderators/focal Services from time to time at its sole discretion. 4.3 The ICTMS must maintain the accessibility of the DSWD Wiserv outgoing and must monitor the incoming functionality of the DSWD Wiserv. 4.4 The ICTMS has the full access to activate newly Registered User / DSWD Wiserv moderators/focal and revoke / deactivate an access of moderators/focal who are found guilty of violating the Wiserv Terms and Conditions. 4.5 The ICTMS must maintain the accessibility of the DSWD Wiserv outgoing and must monitor the incoming functionality of the DSWD Wiserv. 4.6 Dashboards of the incoming and outgoing SMS and moderators’ accomplishments shall be provisioned upon request to ICTMS. 4.7 We are the sole owners of the information collected on this site. We only have access to/collect information that you voluntarily give us via the modules of this website or other direct contact from you. We will not sell or rent this information to anyone. All of the provisions in the Data Privacy Act will be observed specifically on the management of personal identifiable information. 4.8 We will use your information to respond to you, regarding the services that you require. We will not share your information with any third party outside of our organization, other than as necessary to fulfill your requested services. The DSWD however reserves the right to request the applicants to submit the hardcopy of documentary requirements in order to verify the authenticity of the information; 4.9 We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline.

5. CONFIDENTIALITY

5.1 Each Party may be given access to Confidential Information from the other Party in order to perform its obligations under these terms and conditions. A Party's Confidential Information shall not be deemed to include information that: 5.1.1 is or becomes publicly known other than through any act or omission of the receiving Party; 5.1.2 was in the other Party's lawful possession before the disclosure; 5.1.3 is lawfully disclosed to the receiving Party by a third party without restriction on disclosure; 5.1.4 is required to be disclosed by law, by any court of competent jurisdiction or by any regulatory or administrative body. 5.2 Each Party shall hold the other's Confidential Information in confidence and, unless required by law, not make the other's Confidential Information available to any third party, or use the other's Confidential Information for any purpose other than those contemplated under this Agreement. 5.3 Each Party shall use reasonable endeavours to ensure that the other's Confidential Information to which it has access is not disclosed or distributed in violation of the terms of this Agreement. 5.4 The DSWD Wiserv moderators/focal must maintain confidentiality of the DSWD data/record ( Mobile numbers; Contact Details and Message Contents) 5.5 If you feel that we are not abiding by this privacy policy, you should contact us immediately via email ictsupport@dswd.gov.ph

6.EXCLUSION AND LIMITATION OF LIABILITY

6.1 The ICTMS gives you no warranty or assurance, except as set out in Clause 4 above. You acknowledge that all implied warranties and conditions are excluded to the maximum extent permitted by law. 6.2 This Clause 6 sets out the ICTMS entire financial liability (including any liability for the acts or omissions of Registered User / DSWD Wiserv moderators/focal regardless of employment status ) to you in respect of any breach of these terms and conditions, any use made by you of the Registered User / DSWD Wiserv moderators/focal Services; and any representation, statement or tortious act or omission (whether negligent or otherwise) arising under or in connection with these terms and conditions.

7. TERMINATION

7.1 These terms and conditions may be terminated by the ICTMS if you are in material breach of any of these terms and conditions and if the breach is not remedied within the period of 14 working days after written notice of it has been given. 7.2 You may terminate these terms and conditions at any time by giving the ICTMS within 4 working Hours. Termination/deactivation request must be raised via ICT Helpdesk via https://ictsupport.dswd.gov.ph 7.3 On termination of these terms and conditions for any reason, you will no longer be able to use any of the Registered User / DSWD Wiserv moderators/focal Services. 7.4 OBSU / Program must request an immediate revocation of access level of the retired/resigned/end of contract staff to prevent unauthorized use of the system.

8. PRIVACY AND PERSONAL INFORMATION

8.1 The ICTMS is committed to ensuring that your privacy is protected and that the ICTMS is compliant with the Data Privacy Act 8.2 You agree to the use of your data by the DSWD, which is in accordance with the Privacy Policy (https://www.dswd.gov.ph/dswd-privacy-notice).

9. GENERAL PROVISIONS

9.1 If any provision (or part of a provision) of these terms and conditions is found by any court or administrative body of competent jurisdiction to be invalid, unenforceable or illegal, the other provisions shall still be applied 9.2 These terms and conditions shall be governed under Republic of the Philippines law and the Parties submit to the non-exclusive jurisdiction of the Philippines courts 9.3 Service Level Agreement imposed by the Keyword / Access level Owner (OBSU / Programs and Services) shall apply to the inboxes, respectively 9.4 Wiserv accounts that are inactive for 12 months shall be deactivated. Users must request for the reactivation of the account should there be a need to use the DSWD Wiserv. 9.5 User manual is to be shared to the moderators/focals via this link: https://docs.google.com/presentation/d/1LE5bj0fK3UQWmOiuhhkqYlR0ZywmHV6o0BzKoc8j0cU/edit?usp=sharing 9.6 Technical Assistance (TA) requests that include but are not limited to the following: activation/reactivation of account, keyword creation, change of access level, provision of dashboards, one on one system orientation or any related to these matters shall be raised via https://ictsupport.dswd.gov.ph
BY PROCEEDING TO USE THIS SITE, I HEREBY AGREE TO BE GOVERNED BY THE TERMS AND CONDITIONS OF THE DSWD WISERV PRIVACY NOTICE AND USER AGREEMENT. I ALSO HEREBY ACKNOWLEDGE TO HAVE READ AND FULLY UNDERSTOOD THE SAID TERMS AND CONDITIONS.
